Before opening a Free School, an academy trust must enter into a funding agreement with the Secretary of State. The funding agreement provides the framework within which the Free School will operate.
Model funding agreements and annexes are available for all types of Free School. There are variations for single academy trusts and multi-academy trusts. Please note that these model documents reflect the latest legislative and policy positions at the date of publication. The precise terms on which the Secretary of State will enter into an agreement in respect of a particular school will reflect the individual circumstances of the project.
Under Section 10 of the Academies Act 2010, trusts must consult on whether or not to enter into academy arrangements with the Secretary of State. The model funding agreements set out the academy arrangements for Free Schools, and can be used as the basis for carrying out this consultation.
