When a school changes from one school category to another (e.g. community to foundation) there may be a need for the land and buildings used and held for the purposes of the school to transfer to another body.
Details of the provisions which enable a school to change category are set out in Statutory Instrument 2007 No 1289 – The School Organisation (Prescribed Alterations to maintained Schools) (England) Regulations 2007. A copy of this is available to view on the right-hand side of this page.
Details about the procedures for transferring land and an example of a model transfer agreement can be found in the Department's published guidance The Transfer and Disposal of School Land in England, which is available to download from this page.
